Essay answering QUESTION 1
In recent years the Administrative Appeals Tribunal has developed a large backlog of cases and in its most recent annual report it refers to the need to respond to increasing demands on its services. One possible legislative option would be to speed up the merits appeal process by extending key features of the “fast-track review process” in Part 7AA of the Migration Act 1958 (Cth) to other AAT reviews.
Write an essay on this option for addressing the backlog. Your essay must address the following:
1. An analysis of the advantages and disadvantages of the fast-track review process, and
2. Whether it should be adopted more generally for AAT appeals.
You should include in your essay some reference to High Court cases in the course outline that examine the fast-track review process: BVD17 v Minister for Immigration and Border Protection [2019] HCA 34 and CNY17 v Minister for Immigration and Border Protection [2019] HCA 50.
