The High Court allowed the claim from Google unanimously after overturning the decision delivered by the Full Court which allowed the appeal of misleading or deceptive conduct (Google Inc v Australian Competition and Consumer Commission [2013] HCA 1)(“Google” or “Google v ACCC”). The misleading or deceptive conduct refers to ‘corporation shall not, in trade or commerce, engage in conduct that is misleading or deceptive or is likely to mislead or deceive’ in the Pt V5 of s 52 of the Trade Practices Act 1974(Cth) (“the Act”). This article would discuss the facts, issues and ratio decidenci of this case, which would be illustrated further in the part of analysis, addressing the evaluation of the decision of the High Court as well as the business implication, and subsequently attempting to figure out the potential development of policy.
