Often the general conduct of lawyers in practise is subject to close public scrutiny, however, it is also the personal conduct of lawyers that is increasingly acknowledged by the public, which means that lawyers have an ethical obligation to ensure that they reflect the profession positively.1 It is necessary in order to maintain the community’s faith and trust in the legal profession that high standards are upheld and are as such reinforced through the Legal Profession Uniform Law 2014 (NSW).2 There are two different types of conduct that will constitute a breach of a lawyer’s ethical standards of conduct and they include professional misconduct and unsatisfactory professional misconduct, such behaviour will be subject to disciplin...
