Hegel Essay - Distinction Grade 81/100
JURD7236 - Theories of Law and Justice
9 Pages • Essays / Projects • Year Uploaded: 2023
Hegel Question: Hegel's Philosophy of Right situates society (and 'Ethical Life' as he describes it) as the ground of Right (law, justice, legitimate politics...) and sees Right as fundamental to freedom, indeed Hegel directly claims that the Philosophy of Right is a philosophy of freedom that seeks to understand freedom as actualised through social, political and institutional life. On the other hand many hold that this creates an overly tight relationship between individual and society, one which would limit the individuals capacity for criticising their society or dissenting from its norms and thus both individuality and freedom become subordinated to social norms, practices and rules, thus limiting what today we might see as fundamental individual rights - freedom of speech, freedom of conscience, freedom of expression... Explain and evaluate Hegel's stance in regard to these ideas. Do you see this as an adequate account of freedom? Do think that individual rights as we now understand them are secure in the Hegelian state/society? Do you see his theory as providing a proper foundation for law and the apparatuses of justice?
