The Environmental Emissions (Pollution) Act 2010 (NSW) contains the following sections.
4 Object of Act
The overall object of this Act is to create and empower the Environment Agency to monitor and regulate emissions into the New South Wales environment, to protect the health of New South Wales people and the State from pollutants.
Section 15, which is under ‘Part 2 – Pollution’ is as follows.
15 Maximum Emission Levels
The Environment Agency can set enforceable maximum emission levels on any human activity to minimize pollution.
In the Second Reading Speech, the Minister for the Environment stated that:
Through this Act, enforceable standards can be set to control the release of dangerous pollutants like toxic chemicals, smoke and other substances.
The burning of fossil fuels like petrol releases various ‘greenhouse’ gases, in particular carbon dioxide (CO²). There is worldwide concern that increasing levels of CO², building up over decades in the global atmosphere, is contributing to increasing temperatures worldwide. This effect is known as ‘global warming’.
CO² is also produced every time an animal breathes out. Humans naturally breathe CO² in the air all the time, and plants use it to produce oxygen. Most scientists however predict that any more decades of unrestrained burning fossil fuels will lead to melting icecaps, increased droughts and fires, and in a worst case scenario threaten human societies altogether.
The NSW Environment Agency wants to know if it has the power, under this Act, to impose maximum levels of emissions of CO², including on everyday activities such as driving cars. Advise the Agency.
