Intention to create a legal relationship Presumption - Go to the glossary, Page xxi Balfour v Balfour (1919) - There is a presumption that in arrangement between husband and wife the parties do not intend to create legal relations. There is also a presumption that in family arrangements the parties do not intend to create legal relationship. Merritt v Merritt (1970) - The presumption is rebutted where the parties have separated or are about to separate when they enter into the arrangement. And then the court would probably enforce any agreements they make.
