Topic: Don is a citizen of the state of Nowhere. He is currently living in the State of Somewhere. Somewhere is a state party of the United Nations but has not ratified any of the human rights treaties. He is a member of a religious group who call themselves the Dejis. There are around 300 people in Somewhere who are part of this religious group. Don now comes to you as a human rights lawyer. He wants to complain about human rights violation by Somewhere. The police have recently started arresting people who are part of any religious group which is not recognised by the Ministry of Religion and Other Networks (‘MORON’ for short). The Dejis are not recognised by the MORON and Don is afraid that he will be arrested soon. There has been news reports and postings on social media that as many as 100 professing Dejis have been arrested at the order of the MORON. Advise Ron on all the non-treaty procedures under the United Nations and how each procedure can be utilised by him. How would your answer differ if Somewhere was also a State party to the International Covenant on Civil and Political Rights (‘ICCPR’) as well as the First Additional Protocol to the ICCPR?
