Does the legal framework for the recognition of Native Title in Australia priorities non-Indigenous property rights over the rights of First Nations Peoples? Should it? With the purpose of clarifying the legal framework for the recognition of Native Title of property rights to the First Nations Peoples, it is central to address the upbringing of Native Title law, how it was formed and why the statute came into existence. The Native Title Act was created to serve justice by providing a national system for the recognition and protection of native title and for its co-existence with the national land management system.1 Furthermore, as a result of Native Title development in Australia, certain property rights were established applying specific priorities to the First Nations Peoples.
