The issue of domestic violence in Australia has continued to present seemingly insurmountable challenges within the Legal system. Law reform is the modernisation of the law which aims to eliminate defects by taking into account the changes in society’s values and new concepts of justice. Domestic violence is defined as the physical and/or psychological abuse committed by an individual within a victim’s domestic circle. The Apprehended Domestic Violence Orders in the Crimes Act (2007) have failed to protect the rights of individuals due to the unsuccessfulness of the court system in compromising fortification through limited enforceability. The Australian justice system also has an extensive range of restrictions in terms of the accessibility and responsiveness in law reform mechanicians as it is unable to apprehend the long-standing nature of Domestic abuse. Additionally, the law system fails to meet the needs of LGBTIQ+ and male family violence victims due to its unresponsiveness and inability to reflect the rule of law, despite the prevalence of abuse in both circumstances.
