As a general rule, an agent, being in a fiduciary position as against the principal, is not permitted to make a profit out of the performance of his duties as an agent unknown to the principal. This essay discusses that in Malaysia, the Contracts Act 1950 makes no mention of ‘secret profits’ but yet caselaw has recognised it as a duty of an agent not to make any.
