What is equity? As was said by S. Worthington, even the most experienced lawyers find it difficult to give a short and intelligible answer to the question ‘what is Equity’. This article explores what equity really is by investigating its historical origins, characteristics, and contemporary contributions. The first part of the article explores the historical origin of equity and its relationship with common law. The second part of the article talks about the superiority of equity and common law when there existed a conflict between them. The third part of the article introduces maxims of the equity. The fourth part included characterizes the contemporary contributions by delving into the application of modern equity and by referring to three equitable remedies: specific performance, injunction and search order. The fifth part talks about the prospect of equity and draws a conclusion on what Equity actually is.
