Sam and John are flat mates. One night Sam brought Sally back to the flat having met her at a nearby pub. Sally was very intoxicated. Sam took Sally into the bedroom but came out 20 minutes later. Apparently, Sally and Sam had attempted to have sex but Sally had fallen asleep. Sam was very annoyed by this and said to John, who had been watching TV, that there was a woman in his bedroom who just couldn’t get enough sex and that John should go and try and satisfy her. John entered the bedroom and had sex with Sally. Discuss John’s liability for the sexual assault of Sally.
