Brian was suffering from cancer. His doctors had diagnosed it as terminal and estimated that Brian had less than 6 months to live. Brian found a website which offered alternative cures for diseases such as cancer. John was the author of this website and ran a small property in western NSW where sufferers could go to undertake his alternative therapies. Brian decided to undertake these therapies and paid the fees charged. The particular treatment John gave Brian involved meditation plus John’s “secret elixir”. This so-called “secret elixir” consisted of a number of different herbs and plants which John had randomly collected from the forest. John never bothered to check what these herbs and plants were or their effects. A) RECKLESS INDIFFERENCE: b) Intention to kill or cause grievous bodily harm x c) Necessary mental state for an offence which carries a maximum penalty of 25yrs penal servitude X Three days after commencing this treatment Brian became very ill and developed a very high fever. John advised Brian that this was part of his treatment and there was no need to call the doctor. The next morning, Brian was dead. The autopsy concluded that Brian had died from a heart attack caused by an allergic reaction to one of the plants in the “secret elixir”. The autopsy report also stated that Brian would have survived if John had immediately called an ambulance as soon as Brian fell ill. Following Brian’s death, John was interviewed by a current affairs reporter. During this interview, John claimed that he had divine power to heal. The reporter kept questioning John and called John a fake, a fraud and a killer. Infuriated, John violently attacked the reporter kicking him repeatedly to the head and body. The reporter died as a result. In accordance with the instructions, analyse John’s liability for the deaths of Brian and the reporter.
