Firstly, under s 91N, ‘distribute’ is further defined. Part (a) of the definition will capture images which are sent, supplied, exhibited, transmitted or communicated, to another person, facilitated by technology as well as physically sharing or showing in person. Part (b) will incorporate distribution where images were made available for access, regardless of whether another party has actually viewed or accessed the images.1 The definition further leaves open the medium of distribution to include ‘any other means’2 which will capture the emergence of new practices to distribute images.
