The Kirby Institute’s Annual Surveillance Report (2015) depicts that 35,128 Australian cases are present today and the number is still growing, with many either unaware that they have HIV, or others choosing to not disclose to their partners that they have HIV. Due to the increasing amount of HIV transmission rates, the ethical and legal issues of disclosing a HIV status to a sexual partner were discussed and assessed in order to evaluate whether or not HIV-positive individuals should be required to disclose of their status.
