This Human Rights report attempts to scrutinise the issue of asylum seekers in mandatory detention. An issue that has had the utmost fervent reproval by other nation states who argue that Australia has violated inherent Human Rights in defiance of International Treaties and Covenants which have been both signed and ratified into municipal law. The report will in depth discuss the fundamental policy of ‘mandatory detention’ which was instilled in 1992 and various other existing policies at play. The report will end with policy options that may better Australia’s position in the International community on the issue; both in regards to the improvement of conditions in offshore detention and the ending of mandatory detention. The report will conclude with a policy recommendation that aims to put to rest Australia’s immense violations whilst still maintaining a sense of national interest and sovereignty.
