The body of contracts law addresses issues such as the process of negotiating a contract and whether the terms are morally fair or ethical. A contract is a binding obligation voluntarily assumed by two parties, no matter the circumstances. Torts = Unintended legal relationships (i.e. a car crash) vs. Contracts = Intended legal relationships (i.e. contract to buy a car) Australia is a country based on judge-made common law principles on a case-by-case basis. State-made decisions in Courts of Appeal should normally be followed by other states. This leaves the HC to set uniform principles across the country. However, the statues to be applied may vary between states. Courts have an integral role in resolving contract law disputes by peaceful and fair means.
