The Constitution has long been the backbone of Australian businesses faced with the introduction of laws they deem unfair. Specific to this case, these laws may be a potential hindrance on the interstate trading of refined, genetically-modified (GM) products. Businesses may take action against these laws through the application of s 921 and s 1092 of the Constitution. The former maintains that interstate commerce and trading is of a free nature whilst the latter holds that upon any inconsistency between a State and Commonwealth Law, the latter will prevail.
