Henry and Susannah Kable Met in Norwich gaol in 1786. Prison authorities refused to let them marry, even though Susannah became pregnant. S’s sentence was transportation. Baby not accepted by captain because of lack of papers. Turnkey went to see Colonial Secretary, Lord Sydney. Persuaded him to let the baby go with his mother, and also to let the mother and father marry, and for father’s transportation to change from US to Australia. Newspaper coverage. 20 pounds raised. Deposited with ship’s captain for safekeeping. On landing at Sydney, the money had vanished. H and S were convicts. Attainted, ‘civilly dead’ – unable to bring an action against the captain. But, in Sydney, they did, and won. First civil action in Australian law
