Criminalisation Aims • To examine the concept of criminalisation: how crime is constituted and why certain forms of behaviour are proscribed and dealt with as criminal • To understand how the criminal law is historically contingent, culturally specific and socially constructed through race, class and gender Introduction What is criminal, what ought to be criminal, what factors affect the processes of criminalisation? There are two perspectives: (p. 41) • Crime is determined by looking at the behaviour itself • Crime is determined by looking at the social response According to Lacey, something being a crime should not be taken as a given in society as it is difficult to define and societal constructions of a crime can change over time and context (p.42)
