Mi Zhou is an enthusiastic member of the Little Bay Opera Society (LBOS). She sings everywhere. Even her neighbour’s dog likes to sing along with her. But her neighbour, Genevieve Ryan, does not like opera singing, particularly in German. Genevieve claims that it affects her hearing and gives her pain in her ears. She has asked Mi to only sing on weekends. Mi replied, ‘Singing is my life. How can you keep me from singing!’ They did not speak with each other for 6 months, but Mi does restrict her singing at home to Fridays, Saturdays and Sundays. Recently on a warm Monday evening at 10pm, Mi and a friend were in such a good mood, that they sat in Mi’s garden and sang the flower duet from ‘Lachme’. Genevieve had gone to sleep early because she had to work early at her alpaca business the next day. The singing was beautiful but loud, very loud and the dogs barked. Genevieve rushed to the window and shouted, ‘Can you please shut up. I’m trying to sleep.’ Mi and her friend ignored her. Genevieve became very angry and went next door, jumping over the small fence between the gardens. She scolded Mi, ‘You have to shut up. It’s too late. You’re so bloody selfish. You told me before that you weren’t going to sing loudly.’ Mi and her friend were shocked and ran into the small garden shed, where there was only a small window, which was only big enough for a cat to jump out. They locked the door from the inside. In the rush to the shed dropped her music book and it fell on to her knee and caused a bruise which remained painful for the next 2 weeks. Following them to the shed, Genevieve roared, ‘I’ve got you now. When you come out, I’m going to stop you singing forever!’ Genevieve then sat down on a chair outside the door and fell asleep, and went home in the morning. Mi and her friend stayed inside the shed all night until the next morning. Mi comes to you for advice if she can bring an action for assault, battery and/or false imprisonment against Genevieve.
