The legal system of Australia today, is based upon and developed from the traditions of English common law however it is not a mere ‘outcrop’ of the British model. When the first colonists arrived in New South Wales in 1788, they brought with them the English law. Hence the basic principles and foundational components of Australia’s legal system are based upon the British system of law. Despite this, Australia’s legal system has developed independently with the establishment of Federation and limited application of Indigenous customary law.
