In this paper, we seek to examine the relationship between two main concepts that is at the forefront of the Australian OHS legislation, that being the notion of ‘reasonably practicable’ and the strategies to eradicate hazards and risks. We then discuss the way in which the courts and OHS statues have interpreted this particular concept. We will then analyse the definition of the said principles under OHS legislation and discuss some weaknesses in the manner that these provisions are worded and interpreted in the court system. We will also discuss what is meant by ‘reasonably practicable’ and how that is applied. We then conclude with some suggestions to improve this notion by integrating the methods.
