The Family Law Act 1975 (Cth) makes two different kinds of assumptions in its financial provisions and child related provisions. The court’s authority to make property orders at the end of marriage or defacto relations seems to recognize the social reality that care giving work, which in our society is mostly done by women, requires adequate legal recognition. Child related provisions of the FLA on the other hand, promote shared parenting but mostly at the end of a relationship thus overlooking its own earlier assumptions about care giving. Do you agree with this understanding of the FLA and do you think it makes for a fair family Law?
