Legal practitioners must work within either the solicitors or barrister rules before exercising their judgement in accepting or refusing work. A lawyer’s duty to justice and court must come before their duties to the client and they must use this in accessing a client’s claim. The duty of representation is outlined by the solicitor and barrister rules namely a solicitor should not accept a retainer when there are questions of competence or conflicting interests. Lawyers should only act on behalf of a client when they can work honestly and fairly and attend to work promptly. Given this, solicitors should only work in their area of expertise and as a general rule refuse to represent only when there is a good cause to. In adhering to these rules lawyers are able to exercise discretion in accepting cases, it is up to them to decide what amounts to a good cause. It is clear that ...
