The Issue Various federal and state-based legislation gives heterosexual couples a number of rights and obligations from which same sex couples are excluded. For same sex couples, the desire for legal recognition of their relationship is based on the notion of removed institutionalised discrimination and the provision of adequate legal protections. This lack of recognition and differential treatment is contrary to one of the most fundamental principles of international law: the right to equality.
