Sample text Marriage • Marriage was defined by the case of Hyde v Hyde and Woodmansee (1866). This landmark case defined marriage as “the voluntary union for life of one man and one woman to the exclusion of all others”. • The Marriage Act 1961 (Cth) sets out the requirements for a valid marriage: such as marriageable age, consent, not consanguineous, 1-6m notice of marriage • ISSUE 1 • Marriage Amendment Act 2004 (Cth) reaffirmed “between man and woman” • A 2012 ‘Australian Marriage Equality’ found that 64% of Australians are in favour of same sex marriage, including 80% of young people and 53% of Christians o OR: House of Reps Social Policy and Legal Affairs committee
