According to the Australian Bureau of Statistics a family is defined as ‘two or more persons living in the same household related to each other by blood, marriage, de facto, fostering or adoption’. Within various types of family relationships, may involve breakdowns of some sort, due to varying differences. Due to the uncertainty of the longevity of both marriages and de facto relationships, the law has had to cater for the breakdown of relationships and with it aims to achieve justice for all those involved. A major relationship breakdown that is prevalent in Australian society is the dissolution of a marriage, and this is exemplified through the fact that 47,000 divorces were granted in 2014 according to BOCSAR and highlighted in the SMH article “Broken Lives” by Malcolm Brown.
