This is due to advancements in technology as well as changing moral values which have redefined acceptable family relationships. Some of these issues include the usage of surrogacy and birth technology, as well as the recognition of same-sex relationships. In general, the law reform system has been fairly effective in addressing these issues, although there remain unresolved problems. Surrogacy refers to an agreement by which a mother will give a newborn child to the ‘commissioning’ parents. This practise has only been recognized as moral in the past few decades, as society has become more progressive. The Baby M Case 1988 (USA) was a US case that acted as the precedent in Australia. In this case, despite surrogacy arrangements, the mother decided to keep the child when it was born....

To a moderate extent, the law adequately protects family members in relation to birth technologies and surrogacy. Birth technologies and surrogacy both raise many complex, social, emotional and parenting issues in order to reflect moral and ethical standards. There has been a lack of law reform in these areas, which has created inconsistencies between jurisdictions in Australia, reducing the effectiveness of the law and creating inequities between people in different states. Recent law reform has gone some way in addressing these issues, however, the law must be continually reformed in order to reflect the changing nature of family relationships and ensure the protection of children.

Effectiveness of Law Reform surrounding Surrogacy and IVF Treatment

In conjunction, legal and non­legal measures have been effective in dealing with issues surrounding surrogacy and birthing technologies in Australia. In regards to withstanding limitations, the ‘Regulating Surrogacy in Australia’, report published by the Human Right Law Centre, criticised the “complicated and conflicting nature of Australian surrogacy laws and the discriminatory laws that exclude same sex and single intended parents in a number of Australian states”, hence reflecting that national unity, in regards to legislation and the approach to surrogacy and birthing technologies, would be advantageous in increasing the Australia’s enforceability over such procedures, and in increasing the accessibility of such procedures to Australians. Conclusively, however, Australian mechanisms and legislative measures are effective, in recognising the changing nature and concept of family, and in accommodating changing societal values, whilst protecting the rights and freedoms of individuals.
