The Legal System 1. Basic Legal Concepts Meaning of Law Define Law: Is a set of rules imposed on all members of society which are officially recognised, binding and enforceable. Crimes Act 1914, Privacy Act 1988, Age Discrimination Act 2009.  - A set of enforceable rules of conduct - The law attempts to keep pace with out ever changing- society - Laws are imposed by the administrative institutions that govern our society Values: principles, standards or qualities considered worthwhile or desirable within a society. Customs, Rules and Law Customs: guidelines for conducts developed within a community over the years. e.g. Aboriginal customary laws, wedding traditions etc.  - Customs vary depending on the culture, religion and history - refers to the established patterns of behavior that are accepted in a particular social or commercial setting that are of sufficient importance to be enforced (customs made into laws) Rules: guidelines for conducts that are prescribed for particular situations. e.g. rules for a rugby game. - Rules form the basis of laws - Rules can be changed quickly Law: is a set of rules imposed on all member of society which are officially recognised, binding and enforceable. - Created in parliament - Enforced by legal authorities - Laws should reflect traditional and current ethics and values Relationship: - Rules were based on the tradition, customs and values of the group. - If failure to follow rules, there are consequences as do laws. - groups usually put someone or a small group in charge to enforce these rules, and their associated penalties, in modern times this became the government - over time these rules become formalised laws, known in the society as the law.
