UNIT CONTENT Introduction to the course including the structure of criminal law in Australia, jurisdiction, defining a crime, and classification of offences in W.A. The criminal process including players and their roles in the criminal justice system, duty to the court, criminal Responsibility, persuasive and evidentiary, burdens and presumptions. Homicide -human being, Year-and-a-day rule, causation and omission and death. Murder - the offences, intention, grievous bodily harm, dangerous act murder, unlawful purpose and dangerous driving causing death. Manslaughter - Voluntary/provocation, Involuntary/criminal negligence and euthanasia. Assault - Elements of assault, application of force, consent, attempted or threatened assault, mental element for assault, common assault, other assault offences, grievous bodily harm, wounding, stalking and threat offences and consent to Indigenous Law. Sexual Offences - Consent, penetration, mistake, offence, circumstances of aggravation, indecent assault, offences against morality and domestic violence. Property offences including stealing, taking and conversion, things capable of being stolen, ownership, possession and control, permanent deprivation, mistake, passing of possession, finding, asportation, receiving, unlawful use of motor vehicle, robbery, extortion, burglary, damage to property and fraud.
