Exceprt: Criminal courtrooms are a world of rituals, methods, traditions and professionals accentuated by architecture, technical language and Judges’ discretion. Even though we may not completely agree with Carlen’s view of court as “ritual coercion”1, the question of how accessible the courtroom is to the everyday layman is raised. Courtroom observations reveal how across most levels of criminal courts a distinct alienation confronts the average defendant/witness. It is, however, my view that the dichotomy of the courtroom experience as a coercive instrument versus its legal mediating role may be seen as the two necessary ingredients which in reality enables the basic cathartic purpose of our criminal courts – providing effective scrutiny and inducing appreciation of lifeblood societal values.
